Terms of Service

What is covered

Two different things sit under the LibRAGraph name, and these terms cover only the second:

• The vault software, which you run yourself. It is licensed to you under its own open-source license, which accompanies the software and governs your use of it. Nothing in these terms restricts the rights that license grants you.
• This website and the hosted service — sign-in, connection setup, remote reach, fleet management and billing. That is what these terms govern.

The hosted service is optional

A vault is a complete, standalone product. It does not require the hosted service to function, and if you stop using the hosted service your vault keeps running with your content intact.

Your account

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity that occurs under your account. Tell us promptly if you believe your account has been compromised. You must be old enough to form a binding contract where you live.

Your content

Your content is yours. You grant us no license to it, and we claim none. We do not receive the content of your vault, so we cannot and do not access, reproduce, publish, or analyze it. See the Privacy Policy for what we do hold.

You are responsible for having the right to ingest what you ingest, and for complying with the terms of any third-party service you connect to your vault.

Acceptable use

You agree not to use the hosted service to:

• break the law, or infringe anyone’s intellectual-property or privacy rights;
• gain unauthorized access to any system, account, or data, whether ours or anyone else’s;
• interfere with, overload, or degrade the service or the vaults of other users;
• circumvent metering, quotas, authentication, or any other protective measure;
• resell or sublicense the hosted service except under a written agreement with us.

Fees

Paid plans and credits are charged as described at the point of purchase. Fees are billed in advance or against consumption as the plan specifies, and you authorize us to charge your payment method. We may change pricing prospectively, with notice before it applies to you.

Third-party services

When you connect an external service, your use of that service remains governed by its own terms and privacy policy. We are not responsible for it, for changes it makes, or for its availability, and a provider may revoke your access independently of us.

Availability and changes

We may change, suspend, or discontinue parts of the hosted service. Where a change is material and adverse to you, we will give reasonable notice. We do not guarantee uninterrupted availability, and maintenance and outages will occur.

Disclaimer

The website and the hosted service are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free or that it will meet your requirements.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, nor for lost profits, lost revenue, or lost or corrupted data. Our total liability arising out of or relating to these terms is limited to the greater of the amounts you paid us for the hosted service in the twelve months before the claim, or one hundred US dollars.

Your vault’s content is your responsibility to back up. Because it lives on your infrastructure, we have no ability to restore it.

Indemnity

You agree to indemnify us against claims arising from your use of the hosted service in breach of these terms or in violation of law or the rights of a third party.

Termination

You may stop using the hosted service and close your account at any time. We may suspend or terminate access for breach of these terms, for non-payment, or where required by law. On termination your right to use the hosted service ends; your vault and its content are unaffected.

Changes to these terms

We may update these terms. We will update the effective date above and, for material changes, notify account holders. Continuing to use the hosted service after a change means you accept the updated terms.
